1. Preamble

Swan makes available to its customers the Swan mobile application (hereinafter the "Application") allowing them to prove their identity, perform strong authentication, authenticate themselves to access their payment or electronic money account (hereinafter the "Account") and prepare or authorise transactions.

The terms of use of the Account are defined in the general conditions of use or the general conditions of use of electronic money.

Access to and use of the Application that is the subject hereof implies the User's prior and unreserved acceptance of these general conditions of use of the Application (hereinafter the "GCUAs"), which are the responsibility of Swan.

Swan, a simplified joint-stock company (SAS) with a capital of 16999,66 €, whose registered office is at 95 avenue du président Wilson, 93100, Montreuil - registered with the 853 827 103 Trade and Companies Register, is an electronic money institution authorised to provide payment services, approved under number 17328 by the French Prudential Supervisory Authority (Autorité de contrôle prudentiel - ACPR) 4, place de Budapest CS92459 - 75436 Paris Cedex 09 and subject to the supervision of this authority. The list of electronic money institutions is available from the ACPR and on the website https://acpr.banque-france.fr.

2. Definitions

In the GCUAs, capitalised terms and expressions have the meanings set out below, whether used in the singular or plural.

Apple Pay: means the payment platform that uses Apple's technology to enable users to make payments using compatible Apple Terminals and the Apple PIN.

Apple Wallet: means the application made available by Apple to holders of compatible Apple Terminals allowing them to dematerialise and access all types of cards (e.g. loyalty cards, bank cards, boarding passes), tickets (e.g. cinema tickets, show or concert tickets) or coupons and which can be used as a payment instrument when associated with Apple Pay.

Application: means the free mobile application available or downloadable on the User's Terminal enabling them to access the Swan Service, once the User has subscribed to the Service.

Customer: means the person who has subscribed to an Account for their personal or professional needs.

Android PIN: means the code used to unlock Android Terminals and which must be entered by the User each time they receive instructions to use the Application.

Apple PIN: means the code used to unlock Apple Terminals and which must be entered by the User each time they receive instructions to use the Application. The Apple PIN also incorporates Apple's Face ID and Touch ID technologies.

Strong Personal Authentication Device: means the technical device provided personally to the Customer or User enabling them to validate certain sensitive operations (such as access to the Application, adding a new beneficiary, validating a transfer, generating a card, validating an e-commerce card payment, etc.).

Google Pay: means the payment platform that uses Android technology to enable users to make payments using compatible Android Terminals and the Android PIN.

Google Pay Wallet: means the digital wallet developed by Google, in particular for managing the bank cards that the User has entered to use the Google Pay payment service. Google is solely responsible for its operation.

Apple ID: means the personal identifier or iCloud ID, which can be created online at https://www.icloud.com or when activating an Apple device, and which allows access to additional services on Apple devices (Cloud, App Store, device interoperability, etc.).

NFC: stands for Near Field Communication, i.e. short-range wireless communication.

Service: means the use of the Application and, where applicable, of certain features of the Account by the User through the Application.

Terminal: means the terminals under iOs or Android compatible with the Service.
